Your Agreement with UpTime ISP
When you apply for UpTime ISP NBN Broadband with a Business Pack, you should be aware that you are entering an agreement with UpTime ISP.
When you sign up for a service you agree to the UpTime ISP Customer Relationship Agreement, UpTime ISP NBN Fibre Service Description and the UpTime ISP Business Pack Service Description. These are UpTime ISP’s standard terms and conditions for the UpTime ISP NBN Fibre Broadband service with a Business Pack.
The Performance of NBN Broadband Services
When you sign up for a service you agree to the UpTime ISP Customer Relationship Agreement, UpTime ISP NBN Fibre Service Description and the UpTime ISP Business Pack Service Description. These are UpTime ISP’s standard terms and conditions for the UpTime ISP NBN Fibre Broadband service with a Business Pack.
When connected on a service with (for example) a 100 Mbps interface speed, you should not expect that everything that you download from the Internet will be received by you at 100 Mbps!
Access speeds for Silver, Gold, and Platinum plans delivered over FTTN or FTTB may vary, and will depend on various factors, including the length and quality of the cabling from your Premises to the NBN infrastructure.

NBN New Development Charge: $300
Additional once off $300 NBN New Development charge applies if your premises is identified by nbn™ co ltd as being within the site boundary of a new development. To confirm if this fee applies for your new premises, contact UpTime ISP Sales on [email protected].
NBN Subsequent FTTB/FTTN Install Fee: $297 Where you have an existing copper phone service at your premises but elect to have your NBN FTTB or FTTN service installed on a separate copper pair instead of converting an existing service, we may charge you a fee of $297 for installation. You may be charged additionally for any extra materials or labour required to complete the installation.
Incorrect Callout Fee: $297 Where we attend your premises to repair a fault reported by you, but we determine that there is no fault or the fault is caused by Your Equipment, we may charge you a fee of $297 for attendance. You may be charged additionally for any extra materials used to repair Your Equipment or labour beyond 2 hours.
Other NBN fees and charges We may be charged for the below activities. Where we incur these charges, we may bill those charges to you. However, we will notify you of these charges before doing the work or when you make your appointment. We will only proceed with the activity if you agree to pay these charges.
– Non-standard installations
– Subsequent installations
– Additional installations
– Changes to installations
– Cancelled appointments
– Missed appointments (where you are not in attendance at the Premises at the agreed appointment time)
– Repair, modification or removal of equipment
– Invalid faults (where you report a fault with your Service, and the issue is not with NBN Equipment)
– Central splitter installations (where requested by you or required to resolve performance issues with your Service)
– Restored orders (where you ask for an order that has been put on hold to be reinstated)

We have highlighted below some of the important limitations of the UpTime ISP NBN Broadband service:
– No resale of bandwidth
UpTime ISP Broadband services provide access for personal and immediate family or business use only.
– Single location only
UpTime ISP Broadband services are designed to allow one concurrent router login on one specific physical connection (you can of course have multiple users sharing this connection). Logging in at a different physical location to the location associated with the connection may fail to work, or may incur an additional cost of $1 per connected hour.
– Static IP address
UpTime ISP NBN Broadband with a Business Pack provides a static IP address, with a /29 IP subnet available on request and at $6/IP/month charge. IP address assignments are from UpTime ISP address ranges and are retained by UpTime ISP on termination of service. Static IP allocations may be modified by UpTime ISP to address technical requirements at 14 days notice. IPv6 addressing is also available if supported by your equipment.
– Uploads + Downloads
The monthly quota allocation on UpTime ISP NBN Broadband services is counted as the sum of both uploads and downloads.
– No Unmetered Data
The current NBN Fibre plans (released 21/07/2016) and the previous NBN Fibre plans (released 16/12/2015) are not eligible for any unmetered data inclusions. All data on these plans is counted as metered usage of your monthly data quota.
Definitions (in accordance with Australian ISP conventions):
– 1 MB or 1 Mbyte is 1 Megabyte = 1,000,000 bytes.
– 1 GB or 1 Gbyte is 1 Gigabyte = 1,000 Megabytes.
– 1 TB or 1 Tbyte is 1 Terabyte = 1,000 Gigabytes.

This Acceptable Use Policy (“AUP”) outlines the rules and guidelines for the use of internet services provided by Uptime ISP (“we,” “us,” “our”). By using our services, you agree to comply with this AUP. Failure to adhere to this policy may result in suspension or termination of your services.
1. Prohibited Activities
You may not use our services to engage in any of the following activities:
1.1 Illegal Activities
Engaging in any activity that is illegal under applicable local, state, national, or international law, including but not limited to downloading or distributing copyrighted material without permission.
1.2 Infringement of Intellectual Property Rights
Uploading, downloading, posting, transmitting, or distributing any content that infringes on any intellectual property rights, including copyrighted material, trademarks, or patents.
1.3 Harmful Activities
Engaging in activities that may harm others, including the distribution of viruses, malware, or other harmful software.
1.4 Network Abuse
Any form of network abuse, including but not limited to excessive bandwidth usage that disrupts the network or other users, network attacks, or attempting to gain unauthorized access to our network or systems.
1.5 Spam and Unsolicited Communications
Sending or facilitating the sending of unsolicited email, spam, or any other form of unwanted communication.
1.6 Misrepresentation
Impersonating another person or entity, or falsely stating or otherwise misrepresenting your affiliation with a person or entity.
2. Security
2.1 Account Security
You are responsible for maintaining the security of your account, including safeguarding your username and password. You must immediately notify us of any unauthorized use of your account or any other breach of security.
2.2 Network Security
You may not attempt to interfere with or disrupt the integrity or performance of our network, services, or the data contained therein.
3. Content
3.1 Responsibility for Content
You are responsible for the content you transmit, store, or share using our services. We do not monitor or control the content posted via our services, and we do not accept responsibility for such content.
3.2 Prohibited Content
You may not transmit, store, or share any content that is illegal, offensive, defamatory, abusive, or otherwise objectionable.
4. Enforcement
4.1 Monitoring
We reserve the right to monitor your use of our services to ensure compliance with this AUP. This may include reviewing content and usage patterns.
4.2 Consequences of Violation
If you violate this AUP, we may take action, including but not limited to warning you, suspending or terminating your service, and notifying law enforcement if necessary.
5. Reporting Violations
If you become aware of any violations of this AUP, please report them to us immediately at [email protected].
6. Modifications
We reserve the right to modify this AUP at any time. Changes will be effective upon posting on our website at https://uptimeisp.com.au/general-terms-and-conditions/. Continued use of our services after such changes will constitute your acceptance of the new terms.
